MissionThe mission of the Conference of State Bank Supervisors (CSBS) is to support state regulators in advancing the system of state financial supervision by ensuring safety, soundness, and consumer protection; promoting economic growth; and fostering innovative, responsive supervision. The state banking departments regulate various types of financial activity within their jurisdictions, including insured depository institutions such as banks, credit unions, and thrifts, and non-depository financial services providers, such as mortgage lenders and mortgage brokers, consumer finance lenders, payday lenders, check cashers, and money services businesses.MissionDesc

DescThe largest program is the ongoing operation of the Nationwide Multistate Licensing System and Registry (NMLS, or the System). NMLS is a web-based system that allows state-licensed non-depository companies, branches, and individuals in financial services to apply for, amend, update, or renew a license online for all participating state agencies using a single set of uniform applications. NMLS brings greater uniformity and transparency to non-depository financial services while maintaining and strengthening the ability of state regulators to monitor financial services and protect their citizens. Mortgage loan originators employed by insured depository institutions or their subsidiaries are registered through NMLS in accordance with federal regulations. NMLS began operations on January 2, 2008. The State Regulatory Registry LLC (SRR), a wholly owned subsidiary of CSBS, operates NMLS on behalf of state regulators. CSBS, in cooperation with the American Association of Residential Mortgage Regulators, established SRR in September 2006.The Secure and Fair Enforcement of Mortgage Licensing Act of 2008 (the SAFE Act) introduced requirements for mortgage licensees, such as criminal background checks, a credit history review, pre-licensure education requirements, and tests with both national and state law content each applicant must pass to obtain a license. Major milestones achieved by the states, SRR, and NMLS during 2016 include:--> NMLS expansion industries. While the SAFE Act made NMLS a complete repository of companies and individuals licensed/registered in the mortgage industry, since April 2012 state agencies have used NMLS to manage a wide range of non-depository financial services licenses. During 2016, states were utilizing NMLS to license 162 new license types in these expansion industries. Several additional state agencies are scheduled to use NMLS in these expansion industries over the coming years. --> Major System enhancements and new functionality added to NMLS during 2016. Electronic Surety Bonds and streamlined criminal background check for Control Persons were major functionality implemented in 2016. NMLS Electronic Surety Bonds provide a fully electronic method for submitting and maintaining surety bonds for participating state agencies. In 2016, nine states adopted this functionality for 33 license authorities. A streamlined and expedited CBC process for fulfilling state requirements was launched in 2016, saving time and resources for licensees, reducing the burden on individuals required to have a background check under state law, and allowing for collaboration among states. --> The national SAFE MLO test with uniform state content was launched on April 1, 2013 and by year-end 2016, a total of 54 state agencies had adopted the test and retired their respective state tests. --> The (2016) eighth NMLS Annual Conference and Training had an attendance of more than 640 System users and stakeholders. The agenda included sessions relevant to all users of NMLS as well as special sessions relevant to the mortgage, debt, consumer finance, and money services business industries.--> The NMLS Resource and the Federal Registry Resource Center provide NMLS users with resources and materials to assist in the navigation of the System and is continually updated with news and events of interest to the users. In 2016, the state and federal resource centers had more than 2.4 million unique visitors who viewed over 5.4 million pages.--> At the end of 2016, NMLS contained active state licenses or federal registrations for over 30,000 unique companies and over 567,000 individual licensed or registered MLOs --> NMLS administered more than 70,000 test components, bringing the total administered since July 2009 to over 1 million. The System also supervised 111 course providers who delivered almost 2.3 million hours of education through more than 1,600 NMLS-approved courses in 2016.--> SRR held two public industry meetings with the NMLS Ombudsman.--> The NMLS call center answered more than 464,000 inquiries from users. The call center responds directly to queries regarding any System use issues, and directs all specific regulatory, registration, or licensing questions to the appropriate state or federal agency.--> NMLS processing fees remain unchanged for the eighth straight year of system operations.Desc

DescThe government relations function of CSBS is the responsibility of the Policy and Supervision division. The division covers legislative issues and advocacy, regulatory policy, bank supervision practices and coordination, non-depository supervision, and consumer protection. The work of the division focuses on the diversity of the banking industry, right-sizing regulation, and the transition to a new administration, congress and regulatory environment. Staff is also engaged on efforts to enhance the effectiveness of state supervision of banks and non-bank entities. We dedicate significant time and resources to assisting the states in the coordination of multi-state supervision of the non-bank mortgage industry with the Consumer Financial Protection Bureau.Collectively, our goal is to ensure the state financial regulatory system is strongly represented in the formation of federal public policy. We meet this goal by maintaining regular contact with state supervisors to be aware of current issues and coordinate best practices for the benefit of the system.Desc

Form And Line ReferenceFormAndLineReferenceDescExplanationExplanationTxt
Part IV, Line 1b:We are a temporary custodian of funds collected from mortgage licensees who use NMLS. These funds are not recorded on our balance sheet. We receive the funds in a banking/sweep account. We then remit the collected funds the same day they are received to the appropriate state agencies and transfer the portion belonging to SRR as a processing fee to our own operating account. As a result of the National Mortgage Settlement in 2012, $65,000,000 was distributed to the Conference, of which, $16,000,000 was granted directly to the Conference for creating a State Regulatory Fund. The remaining $49,000,000 was to be distributed to the 49 states which were a party to the settlement with the Conference acting as the escrow agent. Since 2012 CSBS has distributed the funds to the states as directed by the states. As of December 31, 2016, the Conference held $2,585,099 due to 5 states.
