APS had an immaterial amount of unrelated business income for the years ended December 31, 2012 and 2011. Under ASC 740-10, Accounting for Uncertainty in Income Taxes, an organization must recognize the tax benefit associated with tax positions taken for tax return purposes when it is more-likely than not that the position will be sustained. APS has filed for and received income tax exemptions in the jurisdictions where it is required to do so. However, APS is still open to examinations by tax authorities from fiscal year 2009 forward.
