| Fin 48 | PART X, LINE 2 | The Conservation Law Foundation and CLF Ventures are qualified as tax-exempt organizations under Section 501 (c)(3) of the Internal Revenue Code and accordingly no provision for income taxes is necessary for these entities. The Agency is a for-profit entity subject to federal and state income taxes. The Agency accounts for income taxes under ASC 740, "Income Taxes." This standard requires recognition of deferred tax liabilities and assets for the expected future tax consequences of events that have been included in the Agency's financial statements or tax returns. Deferred tax liabilities and assets are determined based on the difference between the financial statements carrying amounts and tax bases of existing assets and liabilities, using enacted taxrates in effect in the years in which the differences are expected to reverse. The Foundation recognizes the financial statement benefit of a tax position only after determining that the relevant tax authority would more likely than not sustain the position following an audit. For tax positions meeting the more-likely-than-not threshold, the amount recognized in the financial statements is the largest benefit that has a greater than 50 percent likelihood of being realized upon ultimate settlement with the relevant tax authority. The Foundation has applied this more-likely-than-not threshold to all tax positions for which the statute of limitations remained open and determined there were no material unrecognized tax benefits as of that date. In addition, there have been no material changes in unrecognized benefits since adoption. It is the Foundation's policy to record estimated interest and penalties (if any) as part of management and general expense. Management believes that the income tax returns for fiscal years 2008 and prior are no longer subject to examination by taxing authorities. |
