DescThe Native American Rights Fund (NARF) is the oldest and largest nonprofit national Indian rights organization in the country devoting all its efforts to defending and promoting the legal rights of Indian people on issues essential to their tribal sovereignty, their natural resources and their human rights. NARF believes in empowering individuals and communities whose rights, economic self-sufficiency and political participation have been systematically eroded or undermined. At its inception in 1970, NARF believed that the best hope for Indian survival and development rests with the maintenance of the tribe as an institution. The inherent sovereign powers of a tribe to hold land, to govern tribal members and to command the respect of other units of government are essential to an Indian nation concept. Throughout its history, NARF has held fast to this hope and through its work has insured that this concept has become a reality. NARF currently has approximately fifty ongoing cases and/or projects representing tribes, organizations and individuals. The volume and importance of the cases on NARF's docket illustrates the continuing need and demand for NARF's services. Tribal Supreme Court Project The Tribal Supreme Court Project is part of the Tribal Sovereignty Protection Initiative and is staffed by the National Congress of American Indians (NCAI) and the Native American Rights Fund (NARF). The Project was formed in 2001 in response to a series of U.S. Supreme Court cases that negatively affected tribal sovereignty. The purpose of the Project is to promote greater coordination and to improve strategy on litigation that may affect the rights of all Indian tribes. On September 28, 2015, the Court held its "long" conference at which it considered nearly 2000 petitions filed during the summer months, including five petitions in Indian law cases. In its order list of October 1, 2015, the Court granted review in 13 cases, including the petition filed by the State of Nebraska in Nebraska v. Parker (No. 14-1406) in which the State is challenging whether the establishments in the Village of Pender which serve alcoholic beverages are subject to the Omaha Tribe's liquor licensing and tax regulations. Thus, the Tribal Supreme Court Project has been and continues to prepare for a very busy October Term 2015 ("OT2105"). In June 2015, the Court granted review of two petitions in Indian law cases: Dollar General Corporation v. Mississippi Band of Choctaw Indians (tribal court jurisdiction over non-Indians doing business on-reservation) and Menominee Indian Tribe of Wisconsin v. United States (equitable tolling of statute of limitations in suits against U.S.). The latter two cases are currently being briefed by the parties. Menominee will be argued on December 1, 2015, and Dollar General will be argued on December 7, 2015. In its order list of October 5, 2015, the Court summarily denied review of the four other petitions filed in Indian Law cases in considered during its long conference: Oklahoma v. Hobia (ex parte Young suit in wake of Bay Mills decision); Sac and Fox Nation v. Borough of Jim Thorpe (repatriation of remains of Jim Thorpe under NAGPRA); Torres v. Santa Ynez Band of Chumash Indians (contractor bankruptcy and sanctions involving a tribe); and Wisconsin v. Ho Chunk (state regulation of class II gaming). Judicial Selection Project The Judicial Selection Project is about research and education: to educate the federal judiciary about tribal issues; to educate tribal leaders about the federal judiciary and the judicial nomination process; and to reach out to elected officials and the public at large about the need for judges in the federal courts who understand the unique legal status of Indian tribes. The research objective of the Project evaluates the records of judicial nominees on their knowledge of Indian issues. The analysis and conclusions are shared with tribal leaders and federal decision-makers in relation to their decision whether to support or oppose a particular nomination. The Project works with the U.S. Senate Judiciary Committee to ensure that all nominees are asked about their experience with Indian tribes and their understanding of federal Indian law during confirmation proceedings. As part of its outreach to Indian country, the Obama Administration continues to seek the names of qualified Native American attorneys, tribal court judges and state court judges who are interested in being considered for vacancies on the federal bench. The Project was successful in its work with the White House and U.S. Senate in 2014 to ensure the nomination and confirmation of Diane J. Humetewa, an enrolled member of the Hopi Tribe, to the U.S. District Court for the District of Arizona. Judge Humetewa is the first Native American woman federal judge in U.S. history and only the third Native American to ever hold such a federal district court judge position. We are hopeful that in these eighteen months of the Obama administration we will be witness to-at a minimum-one more Native American appointed to a U.S. District Court and the first Native American in history appointed to a U.S. Court of Appeals. On April 8, 2015, NARF attorney Joel Williams attended the National NALSA Annual Meeting to provide a report for the Judicial Selection Project based on the recently released Native American Attorney Study. The education objective of the Project seeks to replicate the success of the historic visit by Supreme Court Justices O'Connor and Breyer to reservation communities during the summer of 2001. Since then, judges from the U.S. Courts of Appeals for the Ninth Circuit, Tenth Circuit and Eighth Circuit have attended the NCAI Conferences held in Sacramento, Denver and Rapid City respectively. In August 2011 during the Eighth Circuit Judicial Conference, Chief Judge Riley was joined by Supreme Court Justice Alito on a tour of the Pine Ridge Indian Reservation in a visit coordinated by NCAI and the South Dakota Tribes. In September 2011, Supreme Court Justice Sotomayor visited the Jemez Pueblo, the Santa Domingo Pueblo, the Leadership Institute at the Santa Fe Indian School and the University of New Mexico. At the 2014 Tenth Circuit Judicial Conference held in Colorado Springs, John Echohawk was able to meet and talk with Justice Sotomayor regarding a possible visit to Indian country. In September 2014, on her own initiative, Justice Sotomayor visited with tribal leaders during her visit to the University of Tulsa College of Law, the Oklahoma City University and the University of Oklahoma College of Law. In her public remarks during her visit, she is reported as saying "Indian law was 'an area of law I virtually know nothing about' before joining the high court in 2009... 'I needed to be a good student [so I did] a lot of reading,' going back to early court decisions about tribal sovereignty." Tribal and Individual Trust Accounts In Pembina Chippewa v. U.S., NARF represents the Turtle MountainChippewa, Chippewa Cree, White Earth Band of Minnesota Chippewa, and Little Shell Chippewa Tribes in this case against the federal government for misaccounting and mismanagement of their tribal trust fund, the Pembina Judgment Fund (PJF), since the inception of the fund in 1964. In 2006 the Tribes defeated the United States' motion to have the case dismissed. Since August 2007, the parties have been trying to resolve the Tribes' claims primarily through alternative dispute resolution proceedings before a Settlement Judge of the Court of Federal Claims. In August 2009, the parties reached agreement at least for settlement negotiations purposes on the population of "baseline" (non-investment) transactions in the PJF. In July 2015 the parties reached agreement on a monetary amount for settlement of the Plaintiffs' claims in this case. Since that time the parties have been discussing numerous procedural matters and preparing various documents. In Nez Perce v. Jewell, NARF represented forty one plaintiff tribes in this action filed in the federal district court for the District of Columbia in December 2006 seeking full and accurate accountings of their trust funds. Such accountings never have been provided by the federal government which is the trustee for the funds. In 2009 the Tribes represented by NARF in this case were among the over 90 Tribes who wrote President Obama regarding his campaign promise to resolve equitably all Indian trust fund mismanagement litigation against the federal government, by beginning settlement negotiations in this case and other tribal trust cases. In 2010 and 2011, NARF attorneys along with the attorneys for dozens of other Tribes litigating trust accounting and mismanagement claims coordinated and attended many meetings hosted by the President's appointees in Washington, D.C. in preparation for settlement negotiations. In December, 2011, active claims settlement negotiations on a tribe-by-tribe basis began for many Tribes. To dateDesc

DescNATIONAL INDIAN LAW LIBRARY (NILL): NILL is the only law library in the United States devoted to Indian law. The library serves both NARF and members of the public. Since it was started as a NARF project in 1972, NILL has collected nearly 9,000 resource materials that relate to federal Indian and tribal law. The Library's holdings include the largest collection of tribal codes, ordinances and constitutions; legal pleadings from major Indian cases; and often hard to find reports and historical legal information. In addition to making its catalog and extensive collection available to the public, NILL provides reference and research assistance relating to Indian law and tribal law and its professional staff answers over 2,000 questions each year. In addition, the Library has created and maintains a huge web site that provides access to thousands of full-text sources to help the researcher. The Access to Tribal Law Project (ATLP) continues to be an invaluable resource for researchers and practitioners in tribal law. In the last fiscal year, we received updates to 106 Constitutions or Codes from 47 tribes. This is an increase over the updates to 71 Constitutions or Codes from 39 tribes we received in FY2014. We have developed good relationships with a number of tribes who regularly send us updates to their laws as changes are made and we are working to develop relationships with others who have expressed interest. We are emphasizing that NILL is available as a resource for tribes who would like to publish their codes online, but who do not have the staff available to maintain their own website. We would welcome any support from the Board to reach out to tribes that have not been involved to let them know about the project. NILL has reorganized the website for more efficient access to research guides on popular Indian law topics. In addition to reorganization, NILL staff is reviewing and updating the guides. These pages help to answer research questions on a variety of Indian law topics, including: Tribal Enrollment, Finding Legal Help, Prisoner Issues, the Indian Claims Commission, and researching tribal law or federal Indian law. (See http://www.narf.org/nill/resources/) The library offers about 20 guides some of which are visited over 5,000 times per year. These guides allow NILL to save time and serve thousands of researchers online. The Tribal Nation Pronunciation Guide is being developed for the NILL website. Appropriate pronunciations for all federally recognized tribes and Alaska Native Villages will soon be published on the Tribal Law Gateway. We believe this unique guide will be a valuable resource for those who need to communicate with tribes and will allow people to address a tribe in a respectful manner. In early 2015, the NARF website was moved to a new platform. This was a multi-faceted effort that included improvements throughout the website's design, architecture, and platform. Both the NARF and NILL websites were given design updates and new home pages. The new designs make the websites easier to navigate and more visually appealing; less obvious is that the new designs are more accessible by mobile devices and better optimized for search engines. Since the redesign, mobile devices account for 40% of our traffic and more than 50% of our visitors come through organic search engine results (a good indicator that our site is showing up well in search engines). We continue to see strong online activity at all of NARF's online properties. Since the web redesign, the NARF site has seen a monthly average of about 15,000 users viewing about 30,000 pages. The NILL website has seen similar traffic with about 15,000 visitors viewing 36,000 pages each month. Beyond our websites, our Indian Law News Bulletin now has over 1,800 subscribers and our Facebook page has more than 11,000 "likes."Desc
