MissionLAAWs mission is to advance justice and economic opportunity for poor and low-income people and their families at work, in school, and in the community. We fight to ensure that all workers are afforded equal and fair treatment pursuant to local, state, and federal laws. Our staff and Board believe that work and workplace conditions are critical social determinants of health and that employment is essential to self-sufficiency, affords dignity, and facilitates civic engagement. LAAW acts on these principles through a variety of strategies, including: conducting targeted community outreach and education, building the capacity of grassroots organizations, medical service providers, and community-based partner organizations around California to understand and advocate for their rights on the job and beyond. providing brief legal advice and counsel to low-wage workers through in-person legal clinics and legal telephone helplines engaging in strategic litigation to both improve the law for wMissionDesc

ExplanationActivities of the two organizations who received grants were closely monitored by LAAW program officer to the terms in the grant agreement. The LAS-ELC also provides matching grants to student law clerks who are chosen for full-time summer positions with the LAS-ELC after an extensive interview process . After offers are accepted, the human resources staff reviews each student's available funding and allocates budgeted grant funds. The LAS-ELC's policy is to match grants that the students receive from other sources, such as law school public interest organizations and federal work/study programs, so that its summer clerks are equitably compensated.ExplanationTxt

Client Note 1Client Note 1 - Form 990, Part IIIStatement of Program Service Accomplishments 4aLAAWs three largest legal service areas are Direct Services, Enforcement and Impact Litigation, and Outreach and Education.Direct Legal ServicesIn 2017, LAAW provided free legal information and counseling through clinics, helplines, and limited representation to thousands of low-income Californians through our Workers Rights Clinic, Wage Claim Clinic, Disability Rights Clinic, and various legal helplines, as described below, which collectively assist 2,000 to 3,000 workers across the state each year: a. Clinics:i. Workers Rights ClinicsOur Workers Rights Clinics generally operate weekday evenings in underserved communities at 10 different sites throughout California, including: San Francisco (two locations), the Berkeley/Oakland border, Fresno, Santa Ana, Sacramento/Davis, Watsonville, East Palo Alto, and San Diego, and San Bernardino. We also recently laid the groundwork to launch an eleventh Workers Rights Clinic site in South Central Los Angeles. Workers unable to attend an in-person clinic are assisted via weekly phone-in clinics. In 2017, approximately 80 law students and 103 volunteer attorneys participated in over 159 Workers Rights Clinics across the state. At each clinic, trained student counselors conduct intakes with the many clients that appear in person, confer with supervising attorneys to analyze the legal issues arising from that intake, and then provide clients with information, suggest possible solutions, and make relevant referrals as appropriate. Counselors serve an additional and important function: to inform clients when they do not have legal recourse for their problem, while acknowledging clients expressed feelings that they were not treated fairly. The Workers Rights Clinic model relies on volunteers and partnerships with law schools and community organizations. Our Workers Rights Clinic partners are U.C. Berkeleys School of Law, U.C. Davis School of Law, U.C. Hastings College of the Law, and U.C. Irvine School of Law; Stanford School of Law; the University of the Pacific McGeorge School of Law; the University of San Diego, the University of California Los Angeles; as well as East Bay Community Law Center; Central California Legal Services; Legal Aid Society of Orange County; and the Watsonville Law Center, the Los Angeles Black Workers Center, among others. ii. Wage Claim ClinicHeld at San Francisco and Oakland California Labor Commissioners Office locations. The Wage Claim Clinic helps victims of wage theft calculate unpaid wages and complete wage claim forms. In 2017, LAAW attorneys and approximately 39 legal advocates made 30 appearances before the Labor Commissioner at either wage claim conferences or hearings and 26 appearances before the California Uninsurance Appeals Board at unemployment insurance appeal hearings on behalf of indigent and low-wage workers and recently unemployed or disabled workers, successfully secured benefits in 96% of the cases. The wage hearing appearances resulted in favorable judgments, totaling nearly $313,281.27. Several other claims were resolved through negotiated settlements, which produced a total of nearly $156,762.26 in monetary damages to workers for wage and hour violations. In 2017 the Wage Program continued its new project to assist construction workers record mechanics liens on properties when they are underpaid or not paid at all, for the work they perform.iii. Workers Rights Disability Law Clinic: Held at the Ed Roberts Campus, a universally-accessible transit-oriented disability services hub in Berkeley. The Workers Rights Disability Law Clinics services are tailored to the needs of clients with disabilities, who receive information, evaluation, advice, and representation when appropriate, on matters regarding reasonable accommodation and disability-based discriminatory treatment or practices. iv. Legal HelplinesIn addition to the clinics, LAAW operates three legal helplines:(1.)The Chinese Language Helpline: assists hundreds of monolingual or LEP Cantonese and Mandarin speakers each year. (2.)The Project SURVIVE Helpline: assists approximately 200 survivors of domestic violence, sexual assault, or stalking each year. (3.)The Work & Family Helpline: assisted well over a thousand pregnant women, new parents, workers with serious health conditions, and caregivers in 2017.Lastly, through limited representation, attorneys assist individual clients with matters such as: requesting personnel files, drafting demand letters, negotiating informal settlements, assisting clients draft and file charges with the Equal Employment Opportunity Commission and Department of Fair Employment and Housing, and representing workers in pre-litigation settlement conferences and mediations.Impact LitigationLAAW also litigates cases that have a broad impact across a community, a geographic area, an industry, or a large employer. For example: 1. We won a landmark victory in Arias v. Raimondo, 860 F.3d 1185 (9th Cir. 2017), where the Court held that it would constitute unlawful retaliation under federal law for an attorney in an employment lawsuit to call the immigration authorities to have our client deported at his deposition. This precedent-setting decision protects countless undocumented workers from retaliation by third parties acting in an employers interest.2. With co-counsel, we settled a groundbreaking human trafficking lawsuit alleging horrific working conditions on commercial fishing boats that docked in San Francisco. This lawsuit was the first known action brought under the federal Trafficking Victims Protection Act in the U.S. Commercial fishing industry, and the settlement included the unprecedented adoption of a defendants code of conduct that included a requirement that seamen be told of their rights under United States law, setting the stage for industry-wide change.3. We joined Disability Rights Advocates in filing a significant class action against BART on behalf persons with mobility disabilities. Our clients rely on BARTs transit services but are unable to access them because of filthy elevators soiled by human waste, non-working escalators, broken service gates, and other consistent failures in the system. 4. We secured a significant settlement in a Title IX class action brought on behalf of high school girls living in the rural and low-income community of Red Bluff, California. The case was brought to enforce federal law requiring equity for girls in the provision of athletic opportunities. This is one of several similar and successful actions, bringing awareness to parents, schools, coaches, girls, and the community about gender equity in sports programs run by public schools. LAAWs docket also includes enforcement cases that vindicate an individual workers right to unpaid wages, a reasonable accommodation for a disability, a work environment free of discrimination, a medical leave to care for an ill parent, or the right to return to a position after taking parenting leave, and labor trafficking. These cases keep employers accountable, re-enforce and strengthen laws, and, importantly, make tangible differences in our clients lives.Outreach and EducationLAAW believes that educating low-wage workers about workplace rights can protect them from abuse and gives them agency to advocate for their workplace rights. We produce more than 100 print and online Know Your Rights or Do It Yourself resources, including videos, which collectively cover a wide variety of legal rights topics relevant to low-income workers and their families. In addition to the many resources available on our website, www.legalaidatwork.org, we post clinic schedules and links to other helpful websites and sister social and legal services organizations. LAAWs website meets standards for visually-impaired users. Most of our resources are available in Spanish and Chinese, and many are also available in Filipino and Vietnamese. One unique outreach and education project targets the Bay Areas large monolingual or low-English-proficiency Cantonese and Mandarin-speaking community. Our Language Access Coordinator 1) produces a weekly Know Your Rights column in Sing Tao Daily, the nations largest Chinese-language daily; and 2) hosts two weekly employment-related Q&A segments on two major Chinese community radio stations, AM 1400 KEST (Cantonese) and FM 96.1 KSQQ (Mandarin). Together the stations reach an estimated 515,000 Chinese speakers each week.LAAW also conducts in-person outreach and education in specific client communities through presentations. Veterans are an example of a community with serious workplace challenges.
