DescLEGAL PROGRAM: TLC has emphasized litigation and advocacy focused on healthcare, prisons and criminalization, and immigration. Healthcare: Our intersectional litigation (BAGLY v. HHS) has been uniquely successful in keeping pressure on the Biden administration to develop new federal healthcare nondiscrimination regulations after the Trump administration gutted the Obama-era regulations. Because of our intersectional approach, our case has continued longer than any other challenges. The case was briefly stayed to allow the administration do develop new regulatory language, and that stay was lifted at the beginning of June 2022, when the administration had not released proposed rulemaking. DescPOLICY & ORGANIZING: TLC's National Organizing Team leaped into action to strengthen movement capacity and support state-level leaders. We have been active in state-level conversations and coordinated more with the other national trans organizations?National Center for Transgender Equality (NCTE) and the Transgender Legal Defense and Education Fund (TLDEF) - as well formally reconvening our group of state trans activists to support state-level responses. Following the Texas Attorney General's memo equating gender-affirming care with child abuse, TLC's Director of Policy and Programs, Deputy Director of Policy and Programs, and Board Chair joined our partners at the Transgender Education Network of Texas (TENT) to support Trans Day of Visibility actions on March 31, 2022. Form 990, Part III, Line 4dOTHER PROGRAM SERVICES 4: POLICY & ORGANIZING: TLC's National Organizing Team leaped into action to strengthen movement capacity and support state-level leaders. (Cont'd at Schedule O) OTHER PROGRAM SERVICES 5: BLACK TRANS CIRCLES BTC: BTC built on work with a core group of Black trans women/femmes in New Orleans and laid the groundwork for a new cohort in Texas with an initial Texas convening in fall 2022. From fall 2021-spring 2022, we collaborated with the Black LGBTQ+ Migrant Project (BLMP) to co-organize the second Fierce Freedom School, providing in-depth political education to 10 Black trans women/femmes from across the US and globally; in January, we collaborated again to launch the third Fierce Freedom School cohort, with seven new participants eager to learn new tools for their organizing. In related work, we held a Virtual Black Trans Southern Convening in early 2022 to bring leaders together in this time of threat. OTHER PROGRAM SERVICES 6: LGBTQIA+ DISABILITY PROJECT: The Disability Project conducted disability justice trainings for progressive movement organizations and consultants; launched work on a Disabled Trans People's Survey; and piloted a local support project in Chicago distributing packages of N95, KN95, and surgical masks to BIPOC trans/queer disabled and chronically ill people and their carers, with more than 4,000 masks distributed to community members who still need to take strong COVID precautions. OTHER PROGRAM SERVICES 7: GENDER JUSTICE LEADERSHIP PROGRAM/TRUTH: With GSA Network, we provided virtual leadership development for 15 trans youth leaders across the country via TRUTH and further developed Roses, our new leadership initiative for trans girls of color, which includes a leadership group of 5 girls as well as monthly virtual social gatherings to engage and build supportive networks for a wider group of trans girls of color. Especially in the current environment, we have continued to work in partnership with the National Queer and Trans Therapists of Color Network to implement a healing justice curriculum and provide support to youth leaders. In 2022, we began a new program Trans|Trust|Funds, a partnership with Brown Boi Project to teach trans youth leaders about financial literacy. We continued to organize regular virtual leadership trainings and gatherings, and in June organized our second "No PRIDE Without Trans Youth," so we could hear from our youth leaders about what they learned in the 2022 legislative session. Our November 2022 Day 4 Gender Justice Campaign included creating materials that were shared with 775 youth clubs nationwide. OTHER PROGRAM SERVICES 8: BORDER BUTTERFLIES PROJECT: BBP provided approximately 600 vulnerable LGBTQ+ migrants in Mexico and the U.S. with humanitarian assistance. In Mexico, this included shelter, food, and mental and physical healthcare. Two shelters in Mexico are part of the BBP collaborative, and both are consistently full. BBP has been providing shelter to 80-150 people at any time in the past 12 months. We were thrilled to expand our medical partnership with the Refugee Health Alliance to include a psychologist, who goes to the shelters with one of our case managers. In the U.S., we also ensured that migrants were supported and resourced prior to arrival at sponsors' homes, including providing cell phones, clothes if needed, and food during travel, as well as connection to community and humanitarian resources in the United States. As needed, we provided support for participants in the U.S to attend court hearings and related medical appointments including assistance with travel With new staff in place to support migrants who have entered the U.S., we were able to hold virtual convenings monthly for six months. We stepped up our work of connecting participants to local communities and organizations where we had those connections, and also had capacity to be available and engage 1:1 with participants to a greater extent, hearing their stories and helping them to address particular needs. BBP provided direct legal assistance to 1,000 LGBTQ+ migrants in Mexico and the U.S., including helping 700+ migrants to enter the U.S. legally, due to changes in entry processes for a brief window in the second half of 2022. This is more than twice the number we assisted to cross the border in each of the previous two years. We assisted 14 people in immigration detention, as well as an additional 30+ briefly detained by Customs & Border Protection (CBP) and released. We directly supported two clients, who had particularly complex cases, in their asylum hearings. ?The first client was a transgender woman from Guatemala who experienced high levels of trauma and has been living with traumatic brain injury that was only recently diagnosed due to trial prep. With over 1,000 pages of evidence submitted, the government conceded the case prior to court even beginning. Our client was not questioned by either the government nor the judge. This type of win is unheard of in immigration proceedings. The second case was on behalf of a transgender woman from Jamaica. This was an incredibly challenging case because our client had experienced a lot of trauma which made it very difficult for her to participate in the preparation of her case. However, we were still able to submit over 600 pages of evidence and the cross examination was rather short in comparison to other asylum hearings. Asylum was granted. TLC, Familia and BLMP have continued to play a leadership role in movement advocacy for a formal policy against placing transgender migrants in immigration detention. While we have not yet secured a formal policy, we have seen a de facto decrease in detention of transgender people that was sustained through most of 2022. At one point in 2021, we knew of only three transgender migrants in detention, and for almost a year there consistently seemed to be fewer than 10 nationwide. Even if our BBP participants were taken into custody while crossing, we were generally quickly able to secure their release. Given the significant disproportionate vulnerability to abuse and neglect in detention, we continue to push for a formal policy from the Department of Homeland Security. We are starting to notice an uptick in people being detained, and continue to monitor this situation. We are still assessing the impact on our community of new entry processes that began in the second half of January. We continue to attend the ICE quarterly stakeholder meeting, which focuses on vulnerable populations. We continue to raise up issues that impact TGNC people in detention. OTHER PROGRAM SERVICES 9: COMMUNICATIONS - Addressing Violence: In addition to supporting RCGN messaging framework development and implementation, the Comms Team worked to support journalists' essential reporting on laws and rulings affecting reproductive health and justice, releasing a new guide in our Journalist Resource Series, A Language Guide for Journalists and Communities: Abortion and Reproductive Care, designed to support inclusion of trans narratives, trans-specific issues, and inclusive language in the national conversation on reproductive justice. state governments and policymakers in the U.S. We also released a new report (https://transgenderlawcenter.org/roots-anti-trans-violence-indigenous-communities), in collaboration with 'them' online magazine, in our ongoing Roots of Anti-Trans Violence Report Series, focused on Indigenous Communities, specifically the Navajo, Lakota, and Hawaiian nations. Like all of TLC's Roots Reports, it seeks to shift the narrative around violence against trans people from interpersonal to systemic.
Form 990, Part VI, Section B, Line 11bThe Board reviews an electronic copy of the 990 after it has been reviewed by the Executive Director and Treasurer with the preparer. Each member of the Board is provided with an electronic copy of the draft 990 document, before it is filed.

Form 990, Part III, Line 4a - Program Service Accomplishments(Cont'd from Page 2) Bay-Area planning a leadership transition; Garifuna Committee; Hosted STD prevention meeting; Held bi-weekly Garifuna Trans Talks where we have deep discussions around gender within the Garifuna Committee; Children's program was initiated where we hosted LGBTQ education to Garifuna parents and their children, partnering with a child psychologist. Kakuma: Organized support letter for multiple people in Kakuma to advocate for their asylum. Malaika Network: Hosted a Post Release Training with Daniel Say - talked about what sponsorship looks like and how you get post release support; Coordinated and hosted a retreat for the 2nd cohort - August 19-21, 2022; The Malaika Network is a stipended, year-long training and active learning cohort of Black LGBTQIA+ migrants and first generation Black LGBTQIA+ people in the U.S. who develop their knowledge and skills to support deportation defense for Black LGBTQIA+ migrants. Fifteen cohort members developed the skills and knowledge to support deportation defense work, specifically working with detained Black migrants. The Malaika Network training includes legal 101 training about immigration/deportation; deportation defense; and organizing 101; as well as work around developing deportation defense campaigns and post-release support. By the end of the cohort year, these 15 members will have completed individual projects and be ready to assist BLMP in a variety of deportation defense organizing efforts. Individual Support: Continued to support the Paul White case.; Continued work responding to incoming requests for support for detained Black LGBTQIA+ Migrants in FL, MN, SD, etc.; For Border Butterflies Project, began application and interview process for BBP Coordinator position; Continued to support the #FreePaulWhite campaign; Continued work responding to incoming requests for support for detained Black LGBTQIA+ Migrants in FL, MN, SD, etc. Strategic Communications: Began hiring process for Communications Director; Continued work supporting programs team with communications materials, outreach, and online engagement; Created year in review blog post and social media graphics to report on BLMP?s work from the past year for members and supporters.
Form 990, Part III, Line 4b - Program Service Accomplishments(Cont'd from Page 2) By that point, our case was the only case challenging the Trump rule that did not have a stay in place. Facing this ongoing legal pressure, the Biden administration released its proposed rule in late July 2022 (and our case was stayed again to accommodate the rulemaking process). TLC also submitted an extensive comment in support of the new proposed rule, with notes on how to strengthen it further, and helped mobilize community members and allies to submit comments in this process. Federal nondiscrimination regulations are critical as some states work to undermine access to care. TLC is co-counsel in a new case (CB v. City of New Jersey) representing a Black transgender man with autism who was harassed and wrongly arrested by the police, taken to a psychiatric unit at a hospital, and forced to stay there for almost a week. While at the hospital, he was brutalized, beaten, and taunted by hospital staff. False and violent arrests, violence in in hospital settings and the overall mistreatment of transgender people with disabilities are issues that we know need to be highlighted, and this case offers an opportunity to demonstrate that such abuses cannot be and will not be tolerated. Criminalization & Prisons: TLC intervened in Chandler v. CDCR, a case designed to undermine recent prison reforms in California designed to better protect trans prisoners. The challenge to this law is full of false and harmful tropes framing trans women as a danger to cisgender women. We continue as co-counsel for "B," a transgender woman who is facing murder charges in Tennessee. As you may recall, the person B allegedly murdered was trafficking her into sex work and the alleged murder was caught on tape, showing that it was clear self-defense. We believe it is critical to elevate cases like this one so that trans victims of violence are not victimized a second time if they defend themselves. We helped prepare local counsel for a meeting in July 2022 with the County's Chief Deputy DA about this case, and in January 2023 our legal director met with the DA. TLC sustained litigation in a class action suit on behalf of all incarcerated trans women in Colorado (Raven v. Polis) regarding exclusion from women's prisons, failure to provide adequate medical treatment for gender dysphoria, failure to protect trans women from sexual assault and anti-trans violence; refusal to use proper names, pronouns, and honorifics for trans women; and a policy of assigning male staff to conduct pat-downs and strip searches of trans women. Having won key preliminary decisions, we had been engaged in discovery and closely coordinating with co-counsel around the thousands of pages of documentation that have resulted. Via an emergency hearing request, we were able to stop the Colorado Attorney General's office from sending letters seeking to interview trans women in custody (our clients) without us present. Immigration: TLC continued to advance efforts to hold ICE and its contractors responsible in the death of trans Honduran migrant Roxsana Hernandez while in ICE custody, and secured an important victory regarding evidence in the case. In November 2021, we argued our appeal before the Ninth Circuit in a Freedom of Information Act (FOIA) lawsuit to compel ICE and the Department of Homeland Security Office for Civil Rights & Civil Liberties (DHS CRCL) to comply with our requests for documents related to Roxsana's death. In May 2022, the Ninth Circuit held that ICE and DHS CRCL violated the FOIA by failing to adequately search for records and unlawfully withholding federal public records about Roxsana Hernandez. The decision made new law, adopting a more robust standard the government must satisfy to comport with the FOIA. Joining other every other appeals court to consider the issue, the Ninth Circuit for the first time held that federal agencies must demonstrate their search was adequate "beyond a material doubt" - not merely "adequate," as the government had insisted. The Court also found that the agencies illegally withheld public records about Roxsana's death, after TLC provided the agencies with "well-defined requests," "positive indications of overlooked materials,X and "leads that emerge[d] during [the agencies'] inquiry." At the southern border, our collaboration in the Border Butterflies (LGBTQ Migrant) Project (for which we are a fiscal agent, co-coordinator, and home agency for the legal staffing) has deepened and stabilized. BBP assisted approximately 1,000 LGBTQ individuals (in Mexico, while entering the U.S., and after entering the U.S. while waiting for their immigration hearing) in the grant period. We also documented the situation and experiences of BBP participants to better understand needs and barriers. Our direct experience with BBP and the resulting documentation has been a cornerstone for our policy advocacy efforts. TLC was invited to provide input on ICE's vulnerable populations memo, and continued conversations with movement allies about efforts to secure some type of Temporary Protected Status for LGBTQ people outside the U.S. We also partnered with NCLR, Immigration Equality, and Oasis to draft a comment in response to the Biden administration's proposed rule for asylum access, designed to reduce the overwhelming delays in adjudicating asylum claims. We saw some positive elements, as well as some significant concerns, and used the comment to draw attention to both. TLC's Legal Services Project stepped up and responded to increased demand for individualized legal information and referrals through our national Helpdesk and Prison Mail Program. Over the past 12 months, our Helpdesk responded to 1,122 requests for information/referrals, and our Prison Mail Program responded to 832 queries from trans prisoners. We collaborated in two name and gender change legal clinic in San Francisco, and also updated all of our CA online name and gender change forms and guides to reflect the new CA fee waiver form. Our Legal Services Project Manager has been serving on the California Lt. Governor's Trans Advisory Council. We completed our Screening Tool for LGBTQ Victims of Trafficking, which fills a gap in resources, and published two guides on police interactions.
Form 990, Part III, Line 4c - Program Service Accomplishments(Cont'd from page 2) We also partnered with them in our spring fundraiser to strengthen TENT?s ability to reach and benefit from a national pool of donors. At TENT?s request, our Legal Director testified at a Texas Department of Family & Protective Services hearing, addressing the issues of trans youth accessing gender affirming care in foster care, and also focused on how this directive will increase human trafficking victimization of transgender youth. While in Texas, she also built relationships with DFPS workers on the ground and maintained those relationships to help support the litigation that the ACLU and Lambda Legal brought against the directive. At the request of TENT, we drafted a sign-on memo that focused on how this directive will increase human trafficking of transgender youth. Fair and Just Prosecutions, a national progressive prosecutors' group, reached out to us, and we provided valuable edits and feedback on the law enforcement amicus brief they filed in support of the legal challenge. We brought together national activists with state activists from Texas and Alabama for an historic meeting. We continue to work with partners in Alabama and beyond to develop the legal defense strategies and infrastructure that are likely to be needed as families, healthcare workers, and other supporters face the threat of criminalization or investigation for supporting trans youth in accessing healthcare. This included contracting Pooja Gehi, formerly of the National Lawyers Guild and Sylvia Rivera Law Project, to build out a criminal legal defense network in Alabama, a model we hope to expand to other states. To address the need for support with legal fees/expenses and travel costs TLC used our relationships with values aligned reproductive justice groups to launch a fund to cover legal fees and expense for people criminalized due to trans health care ban laws. As our opponents have ramped anti-trans efforts through a frame of "parental rights" (attacking reproductive rights, trans rights, "critical race theory,X and COVID masking rules), we have collaborated with ASO Communications and Lake Research to undertake youth-driven messaging research for a Race/Class/Gender Narrative (RCGN) to build solidarity with trans/nonbinary youth. This includes messaging that has shown effectiveness, for example, in building solidarity around not "putting people in boxes." Most notably, RCGN messaging was shared and deployed by our partner organization, TENT in Texas and is also being shared widely by ASO to their networks. This work helps us create wider public support for trans youth. The National Trans Agenda for Liberation Coalition added six new members and is working to advance the proactive vision of the Trans Agenda for Liberation. The Trans Agenda was cited by the Ford Foundation last year in its discussion of the foundation's vision of gender justice (https://www.fordfoundation.org/news-and-stories/stories/posts/what-the-evolution- of-gender-can-teach-us-about-equality/?mc_cid=4e019bd1dd&mc_eid=9d7ac4774f
