and Political Action Committee, the following footnote speaks to each entity in turn.Income taxes: The Association is generally exempt from income taxes on income under the provisions of Section 501(c)(6) of the Internal Revenue Code. Income from nonexempt functions is subject to unrelated business income tax. The Association had income tax expense, relating to advertising income, of $69,800 and $53,000 for the years ended December 31, 2010 and 2009, respectively. The Foundation is generally exempt from income taxes under the provisions of Section 501(c)(3) of the Internal Revenue Code. Income from nonexempt functions is subject to unrelated business income tax. In addition, the Foundation has been determined by the Internal Revenue Service not to be a private foundation. Under the provisions of the Internal Revenue Code, the Association-PAC is exempt from taxes on income other than non-exempt income, which includes interest and dividends on investments. Deferred taxes are provided on a liability method whereby deferred tax assets are recognized for deductible temporary differences and operating loss and tax credit carryforwards and deferred tax liabilities are recognized for taxable temporary differences. Temporary differences are the differences between the reported amounts of assets and liabilities and their tax bases. Deferred tax assets are reduced by a valuation allowance when, in the opinion of management, it is more likely than not that some portion or all of the deferred tax assets will not be realized. Deferred tax assets and liabilities are adjusted for the effects of changes in tax laws and rates on the date of enactment. The Association follows the accounting standard on accounting for uncertainty in income taxes, which addresses the determination of whether tax benefits claimed or expected to be claimed on a tax return should be recorded in the financial statements. Under this guidance, the Association may recognize the tax benefit from an uncertain tax position only if it is more likely than not that the tax position will be sustained on examination by taxing authorities, based on the technical merits of the position. The tax benefits recognized in the financial statements from such a position are measured based on the largest benefit that has a greater than 50 percent likelihood of being realized upon ultimate settlement. The guidance on accounting for uncertainty in income taxes also addresses de-recognition, classification, interest and penalties on income taxes, and accounting in interim periods. Management evaluated the Association's tax positions and concluded that the Association had taken no uncertain tax positions that require adjustment to the financial statements to comply with the provisions of this guidance. Generally, the Association is no longer subject to income tax examinations by the U.S. federal, state or local tax authorities for years before 2007. The amount invested has been relatively constant in the $20-25 million range for several years. As the investment manager re-allocates among various mutual funds during the year, this shows as a "Gross Receipt" on Page 1- Item G, even though this is not technically a new receipt of outside money to the organization.Page 1, line 12 provides a more accurate total for the taxpayer's 2010 total receipts. Balance Sheet - Other Assets Explanation Included in Other Assets on the Balance Sheet is a $1.9 million investment in SureScripts,LLC. One aspect of SureScripts' business is transmission of electronic prescriptions. Taxpayer made an investment in SureScripts to help it initially get up and running. Taxpayer owns approximately 25% of SureScripts, but does not believe this constitutes control, given the current ownership structure. The investment is shown at original cost, less a valuation allowance. Taxpayer uses comparable compensation data to benchmark other officers and key employees of the organization. An independent compensation analysis firm is utilized to routinely review and compare our established, board-approved compensation program with comparable organizations.
