Description of Uncertain Tax Positions Under FIN 48: Part X: The Foundation, an Illinois nonprofit corporation, is exempt from income taxes under Section 501(c)(3) of the Internal Revenue Code and applicable state law, except for taxes pertaining to unrelated business income, if any. The Foundation follows the accounting standard on accounting for uncertainty in income taxes, which addresses the determination of whether tax benefits claimed or expected to be claimed on a tax return should be recorded in the financial statements. Under the guidance, the Foundation may recognize the tax benefits from an uncertain tax position only if it is more likely than not that the tax position will be sustained on examination by taxing authorities, based on the technical merits of the position. Examples of tax positions include the tax-exempt status of the Foundation and various positions related to potential sources of unrelated business taxable income. As of December 31, 2011, there were no unrecognized tax benefits identified or recorded as liabilities. The Foundation files Form 990 in the U.S. federal jurisdiction and the State of Illinois. The Foundation is no longer subject to examination by the Internal Revenue Service for years before 2008. Documentation is in the file for lectureships and educational programs, and award would need no follow-up. Two or three year grants are paid in a similar manner as the one-year, spread over the term of the grant. The 10% withheld is the same until all reports are received. These multi-year grants submit annual scientific progress reports which are then reviewed by the original peer review committee member. The Vice-Chair of Grants reads all reports, and submits them to the Board of Trustee for approval at the June meeting each year.
