LITIGATION: (See Schedule O for description.)Liberty Counsel staff includes attorneys who assist individuals, organizations, and churches on a pro bono basis with legal issues regarding religious liberty, the sanctity of human life, and the family. Liberty Counsel is committed to representing clients without regard to their ability to pay. Without assistance, most clients could not afford to assert their constitutional rights in court. Liberty Counsel handled more than 1,200 telephone calls for legal assistance during the past fiscal year. A total of 78 cases are currently in active litigation or pre-suit status under Liberty Counsel management. Although the vast majority of legal situations brought to Liberty Counsel are resolved without litigation, others are filed in federal and state courts across the United States. Litigation that is publicized through our media outreach also serves an educational purpose to the public. Quality in litigation is of paramount importance to Liberty Counsel, especially since most of the cases falling within its mission are likely to create important legal precedent for future cases. In his well-documented doctoral dissertation, Professor Hans Hacker concluded that Liberty Counsel accomplishes more with its resources than any other similar legal organization. The following brief synopsis of the hundreds of cases and other legal actions Liberty Counsel undertook in Fiscal Year 2011-2012 is just a sampling of the actual volume of activities. The highlights of Liberty Counsel's activities listed below illustrate its motto: Restoring the Culture by Advancing Religious Freedom, the Sanctity of Human Life, and the Family.Advancing Religious Freedom:Liberty Counsel is involved in numerous precedent-setting cases and handled hundreds of legal issues in its mission to advance religious freedom. Some major highlights include: Stopped the ACLU's intimidation of the Santa Rosa County School District in Florida after two and a half years of intense litigation and restored religious freedom to teachers, staff, students, and members of the community. Obtained court-awarded sanctions amounting to tens of thousands of dollars at both the trial and appellate courts against a Florida attorney who repeatedly filed multiple frivolous and hostile lawsuits against a ministry to the Jewish community. Defended the Dixie County, Florida, Open Forum Policy in a federal court of appeals. The Policy allows private displays of law and history, including the Ten Commandments, outside the courthouse. Successfully concluded an intensive legal defense of the Giles County, Virginia, school board after a high school was sued for posting a donated "Foundations of American Law and Government" display and other historical documents that included the Ten Commandments. Exonerated a high school freshman who was wrongfully given an in-school suspension for sharing his Christian beliefs about homosexuality. The district issued a letter fully vindicating the student's First Amendment right to freedom of religious expression. Successfully defended Child Evangelism Fellowship (CEF) by causing Pajaro Valley Unified School District in California to retract its prohibition of the word "Bible" on the CEF flyers. Stopped the Clay County School District from interfering with constitutionally protected prayer at the flagpole by students, teachers, and community members prior to the start of the school day. Successfully defended Child Evangelism Fellowship against religious bigotry, resulting in the Midlothian, Texas, school district repaying hundreds of dollars to CEF that were charged illegally. Filed a federal lawsuit against Seaside, Oregon, for denying access to the city library for an educational meeting that included religious content. The city eventually settled, granting access and paying damages and attorney's fees. After winning an appeal and following extensive litigation, successfully defended a Florida couple fired from their property management job and evicted from their management apartment, who were told they were "too religious" for displaying in their office a picture of a lily with part of a verse from the Book of Matthew ("Consider the lilies..."), and settled the case for $76,250.Advancing the Sanctity of Human Life: Liberty Counsel has fought for the sanctity of human life from conception to natural death. The following is a sample of Liberty Counsel's actions during the 2011-2012 fiscal year. Liberty Counsel filed the nation's first private lawsuit against the Patient Protection and Affordable Care Act ("ObamaCare") in 2010, challenging the individual and employer mandates, became the first to argue the case at a federal court of appeals, and filed two briefs before the United States Supreme Court. Successfully defended a pro-life sidewalk counselor and obtained a dismissal after two years of federal litigation. The court chastised the government for conspiring with the abortion clinic and filing the case without any evidence, which resulted in the Department of Justice having to pay $120,000. Successfully defended Mississippi's Personhood Amendment at the state Supreme Court against the ACLU, Planned Parenthood, and the Center for Reproductive Rights, thus allowing the citizens the right to vote to amend the state constitution to protect human life from the moment of conception. Successfully defended the Oklahoma Personhood Amendment against Planned Parenthood and paved the way for the citizen initiative to move forward. Filed a significant amicus brief in the Alabama Supreme Court in the case of Ankrom v. State of Alabama, tracing through history the protections afforded to unborn children in a case involving chemical endangerment of unborn children who are exposed to illegal drugs in utero.Advancing Family Values: Here are a few cases and situations involving family issues that required Liberty Counsel involvement during the past fiscal year. Liberty Counsel filed an amicus brief and won a precedent-setting case at the Ohio Supreme Court that protected a biological mother from losing custody to a former same-sex partner. Filed suit at the New York Supreme Court against a new same-sex marriage law in response to the legislature's violations of the state's constitution and legal procedures. Successfully represented a 2010 "Teacher of the Year" in Florida, who, after 22 years of teaching, was suspended from his classroom for expressing disapproval of New York's same-sex marriage law on his personal Facebook page. Buell was reinstated and returned to his classroom. Filed an amicus brief with the U.S. Supreme Court defending the broadcast decency laws against a lawsuit filed by broadcast networks seeking the right to broadcast indecent programming. Defended the Defense of Marriage Act against an initiative led by senators who wanted to overturn the law defining marriage as one woman and one man. Took on the defense of a Massachusetts pastor against a federal lawsuit by a foreign group called Sexual Minorities of Uganda, represented by a radical leftist legal organization partially financed by George Soros, which is attempting to use international law claiming "crimes against humanity" because the pastor spoke in the foreign country against homosexuality and pornography.

The organization designed a newspaper advertisement for use by churches and fielded the resulting telephone inquiries.Internship and Training ProgramsIn 2011, Liberty Counsel's Founder met with Israeli Prime Minister Benjamin Netanyahu and launched the Liberty Ambassador Counsel (LAC), taking people to Israel with the goal of strengthening their Christian faith and equipping them to be goodwill ambassadors for Israel. Liberty Ambassador Counsel educates and connects thousands of Americans with Israel. LAC completed two dynamic trips with visits to Biblical sites and special briefings by leading Israeli political, military, and academic leaders.Liberty Counsel continued its successful legal training program at its 6,000+ square-foot litigation and training office adjacent to Liberty University School of Law in Lynchburg, Virginia. The summer program includes components for second-year law students, college students, and foreign scholars.
