Most of our counseling programs are government funded and these monies do not fully cover the costs of delivering services to our clients. Description of Uncertain Tax Positions Under FIN 48: Part X: The Society and the Memorial, both Illinois nonprofit corporations, are exempt from income taxes under Section 501(c)(3) of the Internal Revenue Code and applicable state law, except for taxes pertaining to unrelated business income, if any. The Society and the Memorial follow the accounting guidance on accounting for uncertainty in income taxes, which addresses the determination of whether tax benefits claimed or expected to be claimed on a tax return should be recorded in the financial statements. Under this guidance, the Society and the Memorial may recognize the tax benefit from an uncertain tax position only if it is more likely than not that the tax position will be sustained on examination by taxing authorities, based on the technical merits of the position. Examples of tax positions include the tax-exempt status of the Society and the Memorial and various positions related to the potential sources of unrelated business taxable income (UBIT). The tax benefits recognized in the financial statements from such a position are measured based on the largest benefit that has a greater than 50 percent likelihood of being realized upon ultimate settlement. There were no unrecognized tax benefits identified or recorded as liabilities during the year. The Society and the Memorial file Forms 990 in the U.S. federal jurisdiction and the State of Illinois. The Finance Director will review and suggest changes. Upon the Finance Director's approval, the draft will then be presented to the Audit Committee for review. Audit Committee recommendations and changes will be incorporated and the final Form 990 will be provided to each committee member of the Audit and Finance Committee for their final review prior to filing. The Form 990 was provided to all members of the governing body before being filed with the IRS. Form 990, Part VI, Section B, line 12c Each Agency stakeholder, including Board Members and Key Employees, is provided with a written copy of the Agency's conflict of interest policy annually in compliance with the conflict of interest policy. It is the responsibility of the Executive Director and Chairperson of the Board of Directors to ensure that all Agency stakeholders maintain compliance with the conflict of interest policy. The forms are reviewed by the Agency's executives and, if a conflict arises, the Board President is made aware.
