These are the driving forces behind everything we do. The Campaign to Eliminate Drunk Driving continued to make great progress in 2013. Two states, Tennessee and Maine, passed laws requiring all convicted drunk drivers to use an ignition interlock device. This brought the total to 20 states that require convicted drunk drivers to use an ignition interlock. States with this type of lifesaving legislation, such as Arizona and Oregon, have reduced drunk driving fatalities by 43 and 42 percent respectively. income of the endowment fund is to be used in Hamilton County, OH for children and public education and awarenes, and to aid victims. PART X, LINE 2: MOTHERS AGAINST DRUNK DRIVING (MADD) is exempt from federal income tax under 501(c)(3) of the United States Internal Revenue Code (the "Code"), except to the extent it has unrelated business income. MADD has been determined by the Internal Revenue Service not to be a private foundation within the meaning of Section 509(a) of the Code. For the years ended December 31, 2013 and 2012, MADD had net unrelated business income of approximately $413,000 and $495,000, respectively. Accordingly for the years ended December 31, 2013 and 2012, a provision for federal income tax has been provided in the accompanying statements of activities and changes in net assets and in accrued liabilities in the accompanying statements of financial position of approximately $157,000 and $174,000, respectively. GAAP requires the evaluation of tax positions taken or expected to be taken in the course of preparing MADDs tax returns to determine whether the tax positions are more likely than not of being sustained by the applicable tax authority. Tax positions not deemed to meet the more-likely-than-not threshold would be recorded as a tax benefit or expense in the current year. A reconciliation is not provided herein, as the beginning and ending amounts of unrecognized benefits are zero, with no interim additions, reductions, or settlements. MADD is relying on its tax-exempt status and its adherence to all applicable laws and regulations to preserve that status. However, the conclusions regarding accounting for uncertainty in income taxes will be subject to review and may be adjusted at a later date based on factors including, but not limited to, ongoing analysis of tax laws, regulations, and interpretations thereof. MADD recognizes interest and penalties, if any, related to uncertain tax positions as income tax expense. MADD's informational returns filed are generally subject to examination for three years after the later of the due date or date of filing. As a result, MADD is no longer subject to income tax examinations by tax authorities for years prior to fiscal year 2010. A revised policy to cover all non-standard contributions, in the event one is received, is now in process. SCHEDULE M, PART I, LINE 32: Mothers Against Drunk Driving (MADD) has contracts with third parties who promote vehicle donations, collect and sell the vehicles, and execute all paperwork required by various agencies. FORM 990, PART VI, LINE 11B: The audit committee and senior management is sent a copy of the form 990 to review prior to filing. Any review comments are incorporated into the final version of the form 990, if necessary. A final copy of the form 990 is sent to the entire board before filing. FORM 990, PART VI, LINE 12C: Mothers Against Drunk Driving (MADD)'s board and senior management must complete a conflict of interest questionnaire annually AND are required to report any new conflict, if any, as it arises. At the beginning of every Board meeting, the Secretary instructs the members to excuse themselves if they perceive a potential conflict of interest as defined by MADD policy. MADD also incorporates a conflict of interest clause in most third-party service contracts. FORM 990, PART VI, LINES 15A & 15B: Mothers Against Drunk Driving (MADD) has an independent Compensation Committee of the Board that evaluates and determines the compensation of its CEO and other Key Employees. The Committee uses compensation data from various resources, such as studies that specifically evaluate salaries of nonprofit employees, in order to determine the reasonability of any compensation it must contemplate and approve. The minutes of the meetings of the Compensation Committee are recorded contemporaneously with deliberation and decision.
