Part V, Line 4: The endowment funds are invested in a well-diversified portfolio and disbursements are made as outlined in an endowment spending policy to support the Foundation's mission. However, as of 2015, OREF has changed its business model and focuses solely on funding orthopaedic research. As part of this change, OREF no longer holds donated funds for other orthopaedic specialty, geographic, and other societies. OREF has distributed to these societies the restricted monies that have been given to OREF and donor-directed to benefit these societies. This enables the societies to invest the funds in a manner consistent with their own goals. Part X, Line 2: The Foundation, an Illinois nonprofit corporation, is exempt from income taxes under Section 501(c)(3) of the Internal Revenue Code and applicable state law, except for taxes pertaining to unrelated business income, if any. The Foundation follows the accounting standard on accounting for uncertainty in income taxes, which addresses the determination of whether tax benefits claimed or expected to be claimed on a tax return should be recorded in the financial statements. Under the guidance, the Foundation may recognize the tax benefits from an uncertain tax position only if it is more likely than not that the tax position will be sustained on examination by taxing authorities, based on the technical merits of the position. Examples of tax positions include the tax-exempt status of the Foundation and various positions related to potential sources of unrelated business taxable income. As of December 31, 2015, there were no unrecognized tax benefits identified or recorded as liabilities. The Foundation files Form 990 in the U.S. federal jurisdiction and the State of Illinois. The Foundation is no longer subject to examination by the Internal Revenue Service for years before 2012.
