The investments are intended to be held in perpetuity and provide cash flow for the expenditures necessary for maintenance and upkeep of the property. Pt II, Line 5 Inspection: Great Land Trust (GLT) inspects each property before accepting a conservation easement. GLT thoroughly evaluates whether the property meets the conservation values as defined by the IRS. Due diligence, including hazardous materials evaluation is conducted on each property. A baseline documentation report is created for conservation easement. Monitoring: GLT monitors each conservation easement at least once annually and records the current conditions of the easement property.Photos and written observations are documented and changes and potential violations are thoroughly documented. GLT makes contributions to a stewardship account to fund the annual monitoring of each conservation easement. Enforcement and violation: GLT intends that its conservation easement enforcement/violation policy conform to all requirements of law, The Land Trust Alliance Standards and Practices, and all other GLT policies. GLT maintains a conservation easement stewardship account which is funded by each conservation easement held by the GLT. This account will provide funds to legally enforce violations of a conservation easement held by GLT. The overall objectives of the violation response and enforcement are as follows: maintain the conservation purposes of the conservation easements; maintain the confidence in GLT's ability to enforce easement restrictions as a deterrent to other potential violators; protect GLT's legal rights and economic investment (if any) in the conservation easement; maintain the most constructive working relationship possible with the landowner; no one person should make decisions on whether a violation has occurred or on our response; maintain professionalism and integrity; where consistent with the foregoing objectives, balance the harm caused by the violation with the cost/benefit of the selected enforcement response; use litigation as a last resort and only when there is a meritorious legal basis for judicial action; and maintain consistent responses to similar conservation easement violations.
