<ExplanationTxt>PART V, SECTION B, LINE 11: FROM THE 2012 IMPLEMENTATION PLAN, THE HOSPITAL WORKED TOWARDS ADDRESSING THE FOLLOWING NEEDS:ACCESS TO QUALITY HEALTH CARE/WOMEN'S HEALTH - DEVELOPED BROCHURES TO EXPLAIN THE NEED FOR MAMMOGRAMS FOR EARLY DETECTION OF BREAST CANCER. BROCHURES ARE AVAILABLE IN THE WAITING AREAS OF THE MEDICAL CENTER AS WELL AS DOCTORS' OFFICES. A PROGRAM WAS SET UP TO OFFER LOW COST OR FREE MAMMOGRAMS TWICE A YEAR FOR PEOPLE WHO MEET CERTAIN CRITERIA. THE CHAT PRESENTATION PROGRAM IS ALSO USED TO GET INFORMATION OUT EXPLAINING THE NEED FOR EARLY DETECTION OF BREAST CANCER AND THE AVAILABILITY OF TESTING.HEALTHY MOTHER, BABIES, CHILDREN/TOBACCO & ALCOHOL USE DURING PREGNANCY - DEVELOPED BROCHURES TO EXPLAIN THE RISK OF SMOKING AND ALCOHOL USE DURING PREGNANCY. BROCHURES ARE AVAILABLE IN WAITING AREAS OF THE MEDICAL CENTER AS WELL AS DOCTORS' OFFICES. THE SMOKING CESSATION PROGRAM THAT WAS DEVELOPED IN THE EAST COUNSELING CENTER WAS EXPANDED TO BE INCLUDED DURING CHILD BIRTH CLASSES IN THE SOUTH MATERNITY AREA. SOUTH ALSO HOSTS A BREASTFEEDING SUPPORT GROUP, CHILDBIRTH EDUCATION CLASSES, HAND WASHING EDUCATION FOR NEW PARENTS, AND INFANT CPR TRAINING SESSIONS.PHYSICAL ACTIVITY AND NUTRITION, OBESITY - A PROGRAM TITLED "HEALTHY HAVEN" WAS PRESENTED TO BOTH SCHUYLKILL HAVEN MIDDLE SCHOOL AND ST. AMBROSE STUDENTS. THE PROGRAM DISCUSSED WELLNESS AS WELL AS NUTRITIONAL EXERCISE INTERVENTIONS. THE HOPE IS TO EXPAND THIS PROGRAM TO OTHER COMMUNITIES. A 5K RUN AND CARBON COUNTY DIABETES WALK ARE ALSO SUPPORTED BY SOUTH TO ENCOURAGE PHYSICAL ACTIVITY.UNINTENTIONAL INJURIES, MOTOR VEHICLES - THIS WAS ADDRESSED IN 2 DIFFERENT WAYS. AS PART OF MAKE A DIFFERENCE DAY, THE MATERNITY/NURSERY DEPARTMENTS HELD A CHILD SEAT SAFETY CHECK. THE GOAL OF THE PROGRAM WAS TO ENSURE SEATS WERE INSTALLED PROPERLY. EDUCATION WAS ALSO PROVIDED FOR ANY RECALLS THAT MAY BE ISSUED. ANOTHER PROGRAM THAT WAS USED DURING HIGH SCHOOL FOOTBALL GAMES TO EDUCATE STUDENTS AND THE GENERAL PUBLIC ABOUT THE DANGERS OF TEXTING AND DRIVING AND OTHER TYPES OF DISTRACTED DRIVING THAT MAY CAUSE ACCIDENTS THAT RESULT IN INJURIES.CHRONIC DISEASE: DIABETES - THERE ARE SEVERAL INITIATIVES THAT THE MEDICAL CENTER HAS TO GET EDUCATIONAL INFORMATION TO THE PUBLIC ABOUT DIABETES. THERE IS A TYPE 2 DIABETES SUPPORT GROUP THAT MEETS TO DISCUSS HOW TO DEAL WITH THE DISEASE. THE MEDICAL CENTER IS ALSO INVOLVED IN THE NATIONAL DIABETES EDUCATION PROGRAM TO HELP PREVENT OR DELAY THE ONSET OF DIABETES. THERE ARE ALSO SEVERAL CHAT PROGRAMS THAT ARE OFFERED TO DISCUSS DIABETES.SCHUYLKILL HEALTH DID NOT ADDRESS ALL THE NEEDS IN THE ASSESSMENT. SCHUYLKILL HEALTH LEADERSHIP HAD A MEETING TO DISCUSS WHAT ITEMS WOULD BE BEST HANDLED BY EACH FACILITY. THE ITEMS THAT THEY DID NOT ADDRESS WERE THEN GIVEN TO APPROPRIATE COMMUNITY ORGANIZATIONS THAT WOULD BE ABLE TO BEST HANDLE THEM. SCHUYLKILL COUNTY VISION ADDRESSES 2 ISSUES THAT WERE IDENTIFIED: 1) PHYSICAL ACTIVITY, NUTRITION, AND OBESITY AND 2) UNINTENTIONAL INJURIES FROM MOTOR VEHICLES. SCHUYLKILL COUNTY VISION TOOK THIS ISSUE ON BECAUSE THEY DEAL WITH A DIVERSE GROUP OF ORGANIZATIONS THAT WOULD BE ABLE TO IMPROVE THESE NEEDS BETTER THAN THE HEALTH SYSTEM. SCHUYLKILL COUNTY DRUG AND ALCOHOL PROGRAM ALSO HANDLED ONE OF THE RECOGNIZED NEEDS FROM THE ASSESSMENT. THEY HANDLED THE NEED TO IMPROVE MENTAL HEALTH AND CONTROL DRUG AND ALCOHOL ABUSE. THEY CHOSE TO ADDRESS THIS NEED BECAUSE THEY WORK WITH THESE ISSUES ALREADY AND ARE MORE PREPARED TO ADDRESS THIS NEED THAN THE HEALTH SYSTEM.IN THE 2016 IMPLEMENTATION PLAN, THE FOLLOWING KEY FOCUS AREAS WERE IDENTIFIED:COMMUNITY ENGAGEMENTWE DEFINED COMMUNITY ENGAGEMENT AS "DEVELOPING COMMUNITY PARTNERSHIPS TO IDENTIFY PRIORITIES AND SUPPORT COMPLEX ISSUES THAT IMPACT HEALTH." SCHUYLKILL WILL FOCUS ON EXPLORING AND BUILDING COMMUNITY PARTNERSHIPS WITH AN AIM TO ADDRESS SOCIAL AND HEALTH NEEDS OF COMMUNITY POPULATIONS.AT-RISK POPULATIONSWE DEFINED AT-RISK POPULATIONS AS "PROVIDING CLINICAL SERVICES THAT MEET A SIGNIFICANT COMMUNITY NEED FOR AN AT-RISK POPULATION, BUT ARE NOT FINANCIALLY VIABLE ON THEIR OWN." SOME EXAMPLES OF AT-RISK POPULATIONS INCLUDE THOSE WITH BEHAVIORAL HEALTH OR PSYCHO-SOCIAL NEEDS. OUR IMPLEMENTATION PLAN ALSO ADDRESSES TOBACCO USE AMONG PREGNANT WOMEN.ACCESS TO CARE AND HEALTH EQUITYWE DEFINED ACCESS TO CARE AND HEALTH EQUITY AS "BEING ATTENTIVE TO THE NEEDS FOR ACCESS TO MEDICAL CARE IN THE COMMUNITIES WE SERVE AND TO EACH PERSON'S LANGUAGE AND CULTURE." SCHUYLKILL WILL ADDRESS THIS NEED IN SEVERAL WAYS: BY RECRUITING ADDITIONAL STAFF AND SPECIALTY PROVIDERS TO PROVIDE CARE FOR SCHUYLKILL COUNTY-AREA PATIENTS, EDUCATING PATIENTS ABOUT LVHN'S FINANCIAL ASSISTANCE POLICY, AND EDUCATING LVH SCHUYLKILL STAFF ABOUT LANGUAGE AND CULTURAL SENSITIVITY.PREVENTION AND WELLNESSWE DEFINED PREVENTION AND WELLNESS AS "INCREASING THE NUMBER OF PEOPLE WHO ARE HEALTHY AND WELL BY EMPOWERING PEOPLE TO TAKE AN ACTIVE ROLE IN THEIR HEALTH AND ADDRESSING ISSUES THAT CONTRIBUTE TO PREVENTABLE DISEASE." SUCHINITIATIVES INCLUDE PROMOTING MAMMOGRAMS, FLU SHOTS, TIMELY PREGNANCY CARE AND OBESITY SCREENING, AND BUILDING AWARENESS ABOUT THE EMERGING OPIOID DRUG USE AND ABUSE ISSUES FACING OUR COMMUNITIES.</ExplanationTxt>

<ExplanationTxt>THE TAXPAYER COMPLETED ITS FIRST CHNA, AS REQUIRED BY SECTION 501(R)(3), DURING THE TAX YEAR-ENDED JUNE 30, 2013. IN ORDER TO MEET THE REQUIREMENTS OF SECTION 501(R) FOR THE TAX YEAR-ENDED JUNE 30, 2016, THE TAXPAYER WAS REQUIRED TO CONDUCT A CHNA PRIOR TO THE LAST DAY OF THE TAX YEAR. HOWEVER, DUE TO EXTRAORDINARY CIRCUMSTANCES, THE TAXPAYER'S CHNA WAS COMPLETED BY JULY 25, 2016, ONLY 25 DAYS AFTER THE CLOSE OF THE TAX YEAR.THE TAXPAYER'S LATE COMPLETION OF THE CHNA STEMS FROM MAJOR FINANCIAL DISTRESS AND TURNOVER IN EXECUTIVE LEADERSHIP. FROM 2014 TO THE PRESENT, THE TAXPAYER HAS STRUGGLED IMMENSELY TO CONTINUE OPERATIONS. IN ADDITION, THE TAXPAYER EXPERIENCED SIGNIFICANT TURNOVER AT THE MANAGEMENT LEVEL, INCLUDING THOSE INDIVIDUALS, SUCH AS THE FORMER CEO, WHO WERE DIRECTLY IN CHARGE OF THE COMPLETION OF THE TAXPAYER'S CHNA. DURING THE 2014 TAX YEAR, THE TAXPAYER'S FINANCIAL TROUBLES RESULTED IN THE TAXPAYER'S AUDITORS RAISING A GOING-CONCERN ISSUE WITHIN THE TAXPAYER'S FINANCIAL STATEMENTS. THE TAXPAYER HIRED THE ADVISORY BOARD COMPANY ("ABC") TO STEP IN AND ASSIST THE TAXPAYER TO OVERCOME ITS FINANCIAL AND OPERATIONAL DIFFICULTIES. SOON AFTER, THE TAXPAYER'S CEO ABRUPTLY RESIGNED. IT IS IMPORTANT TO NOTE THAT THE TAXPAYER'S FORMER CEO WAS PRIMARILY RESPONSIBLE FOR ENSURING THE TAXPAYER CONDUCTED ITS CHNA.ABC SUGGESTED AND MADE MANY OPERATIONAL CHANGES TO THE TAXPAYER'S ORGANIZATION IN A SHORT PERIOD OF TIME. THE BOARD OF DIRECTORS REQUESTED THAT ABC PROVIDE INDIVIDUALS TO REPLACE THE CEO AND CFO OF THE ORGANIZATION. DURING THIS TIME, THE TAXPAYER WAS AT RISK TO SHUT DOWN AND SOUGHT A STRATEGIC PARTNERSHIP IN ORDER TO CONTINUE OPERATIONS. DURING THE 2015 TAX YEAR, THE TAXPAYER DECIDED TO AFFILIATE WITH LEHIGH VALLEY HEALTH NETWORK ("LVHN") AND DUE DILIGENCE COMMENCED. IN APRIL 2016, THE TAXPAYER SIGNED A DEFINITIVE AGREEMENT WITH LVHN AND DURING INTEGRATION PLANNING, IT WAS DISCOVERED THAT THE TAXPAYER HAD YET TO COMMENCE ITS CHNA WHICH WAS DUE BY THE END OF THE 2015 TAX YEAR. AT THIS TIME, THE TAXPAYER PROMPTLY CONDUCTED THE CHNA, WHICH WAS COMPLETED ONLY 25 DAYS FOLLOWING THE CLOSE OF THE 2015 TAX YEAR.TAXPAYER HAS REQUESTED ABATEMENT OF THE EXICSE TAX RELATED TO THE LATE COMPLETION OF THE CHNA. TAXPAYER CONTENDS THAT THE TAXPAYER'S LATE COMPLETION OF THE CHNA SHOULD NOT BE CONSIDERED A FAILURE UNDER SECTION 1.501(R)-2(B)(1), AND THE TAXPAYER SHOULD NOT BE SUBJECT TO THE EXCISE TAX IMPOSED UNDER SECTION 4959. THE TAXPAYER'S LATE COMPLETION OF THE CHNA SHOULD BE CONSIDERED A MINOR ERROR OR OMISSION. THE TAXPAYER'S CHNA WAS COMPLETED WITHIN 25 DAYS OF THE DUE DATE REQUIRED UNDER SECTION 501(R). THE CHNA PROCESS IS LENGTHY AND BEGAN IN EARNEST ONCE THE NEW HOSPITAL LEADERSHIP DISCOVERED THE PROCESS HAD NOT BEGUN. ADDITIONALLY, EVEN THOUGH THE CHNA WAS NOT TIMELY COMPLETED, THE IMPLEMENTATION PLAN WAS COMPLETED, APPROVED AND POSTED IN A TIMELY FASHION. ALTHOUGH THE CHNA ITSELF WAS LATE, NO HARM TO COMMUNITY HEALTH OCCURRED BECAUSE IMPLEMENTATION IS PROCEEDING IN A TIMELY FASHION. THE TAXPAYER COMPLETED A LATE CHNA IN LIEU OF COMPLETING A TIMELY CHNA THAT WOULD BE PARTIALLY INCOMPLETE OR CONTAIN OTHER MINOR ERRORS OR OMISSIONS.</ExplanationTxt>
