Although Cato is generally exempt from income tax, Cato is subject to unrelated business income taxes under Section 512 of the IRC, as well as subject to excise tax on excess lobbying expenses. As a result of the Tax Cuts and Jobs Act effective January 1, 2018, qualified transportation fringe benefits are also considered unrelated business income. Income tax expense related to qualified transportation fringe benefits was approximately $42,400 for the year ended March 31, 2019. Cato believes it has appropriate support for any tax position taken and, as such, does not have any uncertain tax positions that are material to the financial statements.
