As provided in the easement agreement, Article II (Uses and Obligations), Section G (Liability), the Foundation is legally required to carry liability insurance for the easement. As no money changed hands, the basis of the original easement is unchanged. Schedule D, Part II, Line 5 In accordance with Section III, Management of the Trail, of the easement agreement, the Foundation has named a qualified person to act as the Manager. The Manager shall inspect the easement from time to time and shall cause to be performed such maintenance as may be necessary. The property owner has been given the name, address and contact information for the Manager. Schedule D, Part II, Line 9 The Foundation purchased the easement from the property owner, and the purchase price and closing costs have been included on Part IX, Lines 1 and 25 of Form 990. On the Balance Sheet the basis of the easement is reported on lines 10a and 10c, and is included in Total Assets on lines 16 and 33.
