The petition sought to have the court to require that certain assets of the Trust that were originally designated by the Trust to be distributed to The Believers Foundation, Inc. instead be distributed to a named 501(c)(3) public charity. This petition was filed as a precautionary measure to ensure that The Believers Foundation, Inc. is in compliance with the self-dealing rules in Section 4941 and the related Regulations. If The Believers Foundation, Inc. were to have been the distributee with respect to the subject assets, it would have been required to evaluate the exceptions to the self-dealing prohibition in order to address its compliance. The court order, effective retroactively to the date of death of the Trust's grantor, provides that The Believers Foundation, Inc. would not be the distributee with respect to such assets and further, to the extent that the relevant assets may have previously been assigned by the Trust to The Believers Foundation, Inc., The Believers Foundation, Inc. is required to transfer those assets to a named 501(c)(3) public charity as constructive trustee for the benefit of the named 501(c)(3) public charity.
