This program closed 547 cases in 2021. 1123193 20340 LAFLA recently expanded and strengthened its Medical-Legal Partnerships both independently and in collaboration with the Whole Person Care/Medical Legal Partnership of Los Angeles - a consortium of legal services agencies working together to expand the Medical-Legal Partnerships (MLP) throughout Los Angeles County. This innovative legal services delivery model seeks to work with medical providers to assist with the social conditions that are key determinants of health by addressing civil legal issues, such as poor housing conditions, loss or denial of public benefits, immigration status, problems at school or work, or violence within the household. The MLP aims to change the delivery of health care by providing legal services where our clients need us the most - during challenging times. Through this system, anyone from a medical care team can refer patients to our attorneys as part of a comprehensive approach to health care. In 2021, 1,241 cases were closed by our MLPs. Legal VictoriesLAFLA achieved the following legal victories in 2021:Garcia v. City of Los AngelesThe litigation centers on the civil rights of unhoused individuals who are living in tents and makeshift encampments in the City of Los Angeles. The litigation challenges the seizure and destruction of unhoused individuals' belongings. The case challenges the constitutionality of an ordinance in Los Angeles that allows the City to seize and destroy unhoused residents' belongings. Plaintiffs allege that the ordinance violates the Fourth and Fourteenth amendment. They seek declarative relief that the ordinance is unconstitutional, and injunctive relief to prevent the seizure and destruction of property.In 2020, plaintiffs obtained preliminary injunction enjoining ordinance targeting unhoused people; contempt ruling against the City for violating the preliminary injunction. Defendant appealed to the 9th Circuit Court of Appeals.In 2021, the preliminary injunction was upheld by the 9th Circuit.Soza v. LightbourneThis case was filed to challenge the Department of Social Services policy of refusing to reimburse recipients who's CalFresh benefits are stolen by electronic theft.The trial court decided in favor of the respondent Department of Social Services. Petitioners appealed and the Court of Appeal decided in favor of petitioners/appellants. The case was remanded to the trial court to issue the writ and judgment. As a direct result of this case the State of California revised their policy to allow for replacement and/or reimbursement of CalFresh benefits that are electronically stolen. LAFLA's client's stolen benefits were replaced.GHP Management Corporation, et.al. v. City of Los Angeles, et.al.Plaintiff Landlord-Developer has sued the City of Los Angeles alleging that policies protecting renters impacted by the COVID-19 from eviction during the pandemic amount to an unlawful government taking. Intervenors' position is that the policy does not amount to an unlawful taking. LAFLA and co-counsel represent tenants rights organizations who represent the interests of individuals who are rent burdened and unable to pay their rent during the COVID-19 pandemic. LAFLA's clients sought to intervene in the federal lawsuit in order to ensure the interests of low income tenants were represented, and the motion to intervene was granted.LA Alliance for Human Rights, et.al. v. City of Los Angeles, et.al.Property owners are challenging a federal Settlement Agreement signed by the City of Los Angeles over alleged nuisance conditions in Skid Row. LAFLA represents intervenors, who seek to protect the civil rights of individuals experiencing homelessness. Plaintiffs brought an injunction that would have disrupted services for unhoused individuals, that was appealed to the 9th Circuit Court.LAFLA successfully argued in the 9th Circuit and the injunction was denied.Mekan v. Johnson, California Department of Social ServicesLAFLA represents a caretaker relative of a child in the dependency system who suffered sex discrimination and due process violations in the termination of her Resource Family Approval (RFA). Caregivers for foster children must have their home approved under the RFA process, a five-part process involving a background check, mandatory training, a home inspection, and a psychosocial assessment. Denial of RFA has several consequences, including denial of foster care benefits. If this case is successful, indigent children whose relative caretakers are denied RFA based on sex discrimination will, among other things, have access to foster care benefits.LAFLA successfully obtained a stay of the RFA termination. LAFLA is a nonprofit law firm that protects and advances the rights of the most underserved - leveling the playing field and ensuring that everyone can have access to the justice system. For over 90 years, LAFLA has provided free civil legal services to people living in poverty across Greater Los Angeles. LAFLA serves communities as diverse as Pico Union and Westlake, East Los Angeles, the Westside, South Los Angeles, Koreatown and Long Beach. Our unique combination of neighborhood offices, self-help centers at courthouses, and domestic violence clinics puts LAFLA on the front lines in vulnerable communities, and at the forefront of change. LAFLA takes care of the most vulnerable people in our community: the working poor, homeless, unemployed, elderly, disabled, domestic abuse survivors, victims of torture and human trafficking, and veterans of Los Angeles, by providing free legal services. LAFLA also provides free legal education, outreach, and self-help assistance to litigants and community members, allowing for additional access to justice for low-income persons in need. Over 96% of the people served by LAFLA are low-income. LAFLA assists more than 100,000 people in civil legal matters annually by providing free direct legal representation and other legal assistance for people living in poverty in Greater Los Angeles County. In 2021, we also provided important legal information and education to over 12,107 self-represented litigants and gave 17,990 referrals.
