Although the Agency was granted an income tax exemption by the Internal Revenue Service, such exemption does not apply to "unrelated business taxable income". The Agency has been classified as not a private foundation. The Agency analyzes its income tax filing positions in the federal and state jurisdictions where it is required to file income tax returns, as well as all open tax years in these jurisdictions, to identify potential uncertain tax positions. The Agency has evaluated its income tax filing positions for fiscal years 2019 through 2022, the years which remain subject to examination as of September 30, 2022. The Agency concluded that there are no significant uncertain tax positions requiring recognition in the Agency's financial statements. The Agency does not expect the total amount of unrecognized tax benefits ("UTB") (e.g. tax deductions, exclusions, or credits claimed or expected to be claimed) to significantly change in the next twelve months. The Agency does not have any amounts accrued for interest and penalties related to UTBs at September 30, 2022 or 2021, and is not aware of any claims for such amounts by federal or state income tax authorities. Community Action Agency's Form 990 is prepared by the Agency's Chief Financial Officer, who is a Certified Public Accountant, and reviewed by it's Chief Executive Officer. It is received, reviewed and approved by the Agency's Finance and Audit Committee, and ultimately the full Board of Directors. Form 990, Part VI, Section B, Line 12c The Agency's Chief Executive Officer and Chief Financial Officer review with the Board of Directors the Board's Conflict of Interest Policy and make any changes as needed. All Officers, Directors and key employees are required annually the document their understanding and adherence to the Policy and document any interest which could give rise to conflict. The Agency's Executive Committee performs an annual evaluation of the CEO, which includes performance evaluation and compensation comparability. The Executive Committee then makes a recommendation to the full Board of Directors.
